Note: These Terms of Service govern your use of the Brutal Systems website only. They do not constitute or replace a customer, beta, or professional services agreement. Access to BS*Cohort, BS*Sift, BS*Coldfire, or any other Brutal Systems product is governed by a separate written agreement.

01Acceptance of Terms

By accessing or using the Brutal Systems website at brutalsystems.com (the “Site”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the Site.

These Terms apply to all visitors, users, and others who access or use the Site. Brutal Systems (“Brutal Systems,” “we,” “us,” or “our”) reserves the right to modify these Terms at any time. Continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.

02Use of the Site

You may use the Site for lawful purposes only. You agree not to:

Use the Site in any way that violates applicable federal, state, local, or international law
Transmit any unsolicited or unauthorized advertising or promotional material (spam) to us or through any address published on the Site
Impersonate Brutal Systems, a Brutal Systems employee, or any other person or entity
Attempt to gain unauthorized access to any portion of the Site or its related systems, including any area excluded by our robots.txt or otherwise not linked from the public home page
Use automated tools (bots, scrapers, crawlers) to access the Site in a manner that exceeds normal human usage or places undue load on our servers
Harvest email addresses or other contact information from the Site for bulk outreach, resale, or list-building
Introduce viruses, trojans, worms, or other malicious or technologically harmful material
Interfere with or disrupt the integrity or performance of the Site

03Intellectual Property

The Site and its entire contents — including but not limited to text, graphics, logos, marks, images, and software — are the property of Brutal Systems or its content suppliers and are protected by United States and international intellectual property laws. This includes the Brutal Systems name and logo and the BS*Cohort, BS*Sift, and BS*Coldfire names and marks.

You may view, download, and print pages from the Site for your own personal, non-commercial use, provided you do not modify the content and you retain all copyright and proprietary notices.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site without our prior written consent. This includes ingesting the Site or its contents into a dataset used to train, fine-tune, or evaluate a machine learning model.

04Product Information Is Not a Commitment

The Site describes products and capabilities that are in development, in private beta, or otherwise not generally available. Nothing on the Site is an offer to sell, a promise of future availability, or a guarantee of any particular feature, performance level, price, or release date.

Descriptions of work in progress are forward-looking by nature and are subject to change or cancellation at any time without notice. Do not make purchasing, staffing, or architectural decisions in reliance on them. Any commitment we make will be in a signed written agreement.

The content on this Site is provided for general informational purposes only. It does not constitute professional IT, engineering, legal, financial, or business advice. We do not warrant that the Site will be uninterrupted or error-free, that defects will be corrected, or that the Site or the servers that make it available are free of viruses or other harmful components.

08Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BRUTAL SYSTEMS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SITE OR ITS CONTENT.

In no event shall Brutal Systems’ total liability to you for all claims arising out of or related to the Site exceed $100 USD.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. If you are in such a jurisdiction, some of the above limitations may not apply to you.

09Indemnification

You agree to defend, indemnify, and hold harmless Brutal Systems and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Site.

10Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Site, you consent to the data practices described in our Privacy Policy.

11Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, without giving effect to any choice or conflict of law provisions. Any legal action or proceeding arising out of or related to these Terms or the Site shall be brought exclusively in the federal or state courts located in Kent County, Michigan, and you consent to personal jurisdiction in those courts.

12Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Brutal Systems regarding your use of the Site and supersede all prior and contemporaneous agreements, representations, and understandings.

If any provision of these Terms is held to be invalid or unenforceable, that provision shall be limited or severed to the minimum extent necessary, and the remaining provisions shall remain in full force and effect. Our failure to enforce any provision is not a waiver of it.
